Privacy Statement

Kamakura Corporation

Last revised: May 1, 2007
PLEASE READ THIS PRIVACY STATEMENT ("AGREEMENT") CAREFULLY BEFORE USING THIS WEBSITE.

We share your concern about the protection of your personal information online. This is our policy regarding the privacy of information we collect on this website and all site-related services (collectively, the "Site").

Note that, by accessing and/or using the Site, you signify your agreement to this Privacy Policy. If you do not agree to this Policy, please do not access or use the Site. We reserve the right to modify this Policy at any time without prior notice. Your continued use of the Site subsequent to changes to this Policy will mean that you accept the changes; therefore, please bookmark this page and review it frequently. If you have any questions regarding this Policy or the Site, please e-mail us at info@kamakuraco.com.

Information Gathered/Tracked by Us

We gather two types of data about users: (a) personal information, which individual users provide through registration to the Site for access to certain content or services, and for purposes of participating in the Discussion Forums (all such users, "Subscribers"), and voluntarily at certain other points; and (b) tracking information, which is automatically collected about every visitor to the site, both Subscribers and non-subscribers.

Personal Information

Personal information is gathered in several ways. First, when a user registers with the Site, he or she is required to provide his or her name and email address, and to select a password. Additionally, we ask Subscribers to provide us with the name of their organization, their industry focus, and their geographic location.

In addition to registration for subscriptions, you may be required to enter personal information at other times, including (but not limited to) when you take a survey on the Site. If you contact us (including, but not limited to, contact through email), we may keep a record of that correspondence. Wherever we collect personal information, we will make an effort to include a link to this Privacy Policy on that page.

Email Updates

During the registration process, Subscribers may opt to receive various email updates that we send out, including daily, weekly or periodic updates of conferences, selected stories, and risk management information, which may include some advertisements and hyperlinks to the Site. Additionally, your contact information may have been collected by attending a Kamakura sponsored conference, industry related conference or personally given to Kamakura Corporation by the subscriber, an employee of the subscriber or an affiliate of the subscriber. Any Subscriber who wishes to be removed from the mailing lists of one or more of these updates can do so at any time by visiting the Kamakura Home page and selecting the subscription button or by emailing webmaster@kamakuraco.com.

Discussion Forums

We provide Discussion Forums for user discussion of various topics. Only Subscribers are permitted to post or read messages on the Discussion Forums. Please note that information that you post to a Discussion Forum will be available for any user of that service to read, and is no longer private.

Surveys/Polls

Subscribers may participate in risk management surveys on the Site, which are usually for purposes of allowing (a) users to benchmark their firm's risk management policies against industry best practices, or (b) us to obtain general information about our users, for example, their risk management experience or their reactions to a particular article on our site. Because information obtained in these surveys is connected with individual users, participation is voluntary.

Tracking Information

Tracking data consists of individual tracking information and aggregated tracking information, and is automatically gathered using "cookies". A cookie is a small data file containing information such as a user's login name that is written to the user's hard drive by a Web server, and used to track the pages visited. Cookies that we use are encoded and contain a unique digital signature to prevent tampering. They do not contain Subscriber passwords. The information gathered in this manner is used for internal purposes only, such as accessing a user's account information in connection with operating the site. We also use the information on an aggregate basis, to track readership of content and analyze traffic patterns on our site.

Use of the Information

We use information obtained from our users as stated in this Privacy Policy, and to enhance users' experience on our site. We do not rent or sell any personal information about our Subscribers or other users. As a general rule, we will not disclose any personal information to any third parties, except when we believe in good faith that the law requires it, to protect ourselves, our affiliates, providers or other users, or to respond to an emergency. Information is also disclosed if a user has given permission, for example by voluntarily entering a contest, where the information required to register for the contest. Tracking information is used to create aggregate reports on user demographics and site traffic patterns. We may provide such tracking or other aggregate information to our affiliates and our current and potential advertisers, content providers or strategic partners, in order to enhance the features or services available on or through the Site; however, none of the information provided to them can be connected to the identities or other personal information of individual users.

Please note that we reserve the right to disclose information submitted by or concerning any user of the Site as we reasonably feel is necessary to protect our systems or business. Specifically, but without limitation, we reserve the right to disclose such information when a user is in violation of our Terms of Use or other published guidelines, or partakes (or is reasonably suspected of partaking) in any harmful, infringing or illegal activity, even without a subpoena, warrant, or other court order, and to disclose such information in response to court and governmental orders, civil subpoenas, discovery requests, and as otherwise required by law, as well as in response to allegations of infringement. We cooperate with law enforcement agencies in identifying those who may be using our servers or services for illegal activities. We also reserve the right to report any suspected illegal activity to law enforcement for investigation or prosecution, or to suspend or terminate a user's subscription in connection with any suspected illegal or infringing activity.

Information Collected by Third Parties

The Site contains links to other third party websites, including affiliated sites which may or may not be owned or operated by or in conjunction with us. You acknowledge that we do not monitor or control the information collection or privacy practices of any third parties, and are not responsible for their practices or the content of their web sites, including their use of any information (such as IP number, browser type, or operating system) collected when you "click through" links to their sites or view advertisements served by them. Even though certain information collected by such third parties might not identify you personally, we strongly encourage you to become familiar with their privacy practices, and to contact such third parties if you have any questions about their respective privacy policies.

Changes to Personal Information; Canceling Subscriptions

These can be done by visiting our home page and selecting the subscribe button or by emailing webmaster@kamakuraco.com. In addition, if you would like to have your personally identifiable information removed from our database, please contact us at webmaster@kamakuraco.com, and we will use reasonable efforts to comply with your request. Keep in mind, however, that there will be residual information that will remain within our databases, access logs, and other records, which may or may not contain such personally identifiable information. The residual information will not be used for commercial purposes; however, we reserve the right, from time to time, to re-contact former users of the Site.

Security

We use reasonable security methods to protect the data that resides on our servers. However, no security system is impenetrable. We cannot guarantee the security of our servers, nor can we guarantee that information that users supply will not be intercepted while being transmitted over the Internet.
